The Platform is owned by Nexvaida (SK ENTERPRISES) , a company incorporated under the Companies Act, 1956, with its registered office at Jhansi, Uttar Pradesh (hereinafter referred to as the “Platform Owner,” “we,” “us,” “our”).

Your use of the Platform, services, and tools is governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. By merely using the Platform, you shall be contracting with the Platform Owner, and these Terms of Use, including the policies, constitute your binding obligations with the Platform Owner.

Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies, officers, directors, agents, and employees from any claim, demand, or action, including reasonable attorneys’ fees, made by any third party due to or arising out of your:

• Breach of these Terms of Use, Privacy Policy, or other policies,

• Violation of any applicable law, rules, or regulations,

• Infringement of third-party rights (including intellectual property rights).

Limitation of Liability

In no event shall the Platform Owner be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, revenues, business interruption, opportunities, or data.

Our liability, whether arising in contract, tort, negligence, warranty, or otherwise, shall not exceed the amount paid by you for using the Services that gave rise to the claim, or Rs. 100 (Rupees One Hundred), whichever is lesser.

Force Majeure

The Platform Owner shall not be held liable for any failure or delay in performance of obligations under these Terms if such failure results from events beyond reasonable control, including but not limited to acts of God, natural disasters, war, strikes, government orders, or internet disruptions.

Governing Law & Jurisdiction

These Terms of Use and any disputes arising out of them shall be governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of the courts at Jhansi, Uttar Pradesh
